UPDATE: CFTC publishes rulemaking plan for CTX and CAM crypto regulations

The CFTC issued an ANPRM introducing the CTX and CAM frameworks following stalled legislation. Spot trading with delivery under 28 days stays under state law.

The U.S. Commodity Futures Trading Commission published an Advance Notice of Proposed Rulemaking on October 5, 2026, outlining a federal regulatory structure for digital assets. The publication provides details on the agency's plan to independently draft rules under its existing statutory authority, as previously reported after the Senate failed to advance the CLARITY Act.

Announced by CFTC Chairman Michael S. Selig, the proposal introduces Regulation Crypto Asset Transactions for retail margined or leveraged trades and Regulation Crypto Asset Markets for federal exchange licensing. Spot trades resulting in delivery within 28 days will remain subject to state jurisdiction rather than federal oversight.

The rulemaking effort comes alongside an inter-agency Memorandum of Understanding with the SEC to align token definitions. The proposal is open for public comment for a 60-day window.
