UPDATE: NY AG details conditional $35M settlement and ban for Alex Mashinsky
CIE News ·
Alex Mashinsky faces a lifetime ban across crypto, securities, and commodities, alongside up to $35M in conditional payments tied to his federal sentence and DOJ forfeiture, the New York AG announced on Oct. 9.
On October 9, 2026, New York Attorney General Letitia James announced a settlement permanently barring former Celsius CEO Alex Mashinsky from participating in, promoting, or conducting business in the cryptocurrency, securities, and commodities sectors. As previously reported when the $35 million resolution was reached, the deal resolves civil charges accusing Mashinsky of misleading depositors and defrauding more than 26,000 New York residents while concealing heavy trading losses.
The agreement imposes up to $35 million in conditional financial penalties, according to ny.gov and Bitcoin.com News. Mashinsky must pay $25 million to New York if he fails to satisfy a $10 million forfeiture obligation to the U.S. Department of Justice under his criminal plea agreement. He must also pay an additional $10 million if he fails to serve his full 12-year federal prison sentence, which can be triggered by early release programs, sentence reductions, or home confinement.
The lifetime ban covers executive positions, financial advice, and customer solicitation without geographic limits, Bitcoin.com News reported. Mashinsky is currently serving his 12-year term after pleading guilty to federal securities and commodities fraud charges.
