On October 16, 2026, Commodity Futures Trading Commission Chairman Michael Selig confirmed the agency is preparing a regulatory framework for retail crypto asset transactions under Section 2(c)(2)(D) of the Commodity Exchange Act. The planned Regulation CTX framework seeks to establish proof-of-reserve standards, mandatory segregation of customer assets, and listing review standards. The CFTC had previously issued an Advanced Notice of Proposed Rulemaking on October 5, 2026, following the conclusion of a White House regulatory review.
Simultaneously, Securities and Exchange Commission Division of Trading and Markets Director Jamie Selway confirmed that five designated contract markets filed Form 1-N to operate as security futures exchanges. At least four of those entities intend to introduce perpetual futures on securities during the fourth quarter of 2026 using an SEC Innovation Exemption. According to Baker Botts, agency rulemaking is filling a gap after the Senate failed to advance the Digital Asset Market Clarity Act in September 2026.
