The SEC finished accepting public feedback on Regulation Crypto Assets on October 20, 2026, moving the proposal to final review ahead of the GENIUS Act taking effect.
The U.S. Securities and Exchange Commission concluded its public comment period for proposed rule File No. S7-2026-27, titled Regulation Crypto Assets, on October 20, 2026. The framework introduces tailored exemptions from registration requirements under the Securities Act of 1933, featuring a one-time $5 million startup tier across four years alongside a $75 million exemption for each 12-month period.
The proposed rules also incorporate safe-harbor provisions for tokens once an issuer finishes or permanently stops essential managerial efforts, alongside state-level securities law preemption. Filings submitted ahead of the deadline from organizations including the Hyperliquid Policy Center, Bitwise, and AIMA asked for safe harbors governing programmatic buybacks, secondary market trading, and airdrops.
According to forkast.news, the proposal marks the final public input period before the GENIUS Act takes effect on January 18, 2027. The SEC framework codifies a definitional taxonomy that excludes qualifying payment stablecoins and digital commodities from securities rules, directing stablecoin oversight to banking regulators. Following the end of the public comment window, the proposal enters its final administrative review stage before formal adoption.
